Liability Disclaimer & Assumption of Risk
Please read this document carefully. By using the website scubaquestwi.com or inquiring about our training programs, you acknowledge that you understand the inherent risks associated with scuba diving and agree to the terms outlined below.
1. Website Content and General Information Disclaimer
All information, blog posts, course descriptions, advice, and media provided on this website are for educational, informational, and promotional purposes only.
- Not a Substitute for Training: Reading this website, watching our videos, or communicating with us online does not qualify you to dive, handle compressed gases, or conduct underwater activities.
- Professional Instruction Required: Scuba diving requires hands on, practical training under the direct supervision of a certified professional. Relying solely on information found on the internet to attempt diving maneuvers or equipment configurations is highly dangerous and can lead to severe injury or death.
2. Acknowledgment and Assumption of Risk (Scuba Diving Activities)
Scuba diving, including recreational diving, technical diving, skin diving, and training activities using compressed air or mixed gases (such as Nitrox), involves inherent risks that cannot be entirely eliminated, regardless of the care, mentorship, or safety measures taken by the instructor.
By enrolling in or preparing for any course with Scuba Quest WI LLC, you explicitly acknowledge and understand that underwater training involves physical risks, including but not limited to:
- Decompression sickness, arterial gas embolism, air expansion injuries, and drowning.
- Equipment malfunctions or failures under pressure.
- Variations in environmental conditions, including low visibility, sudden water temperature shifts, currents, and unpredictable local open water environments (such as Wisconsin lakes and quarries).
- Physical exertion, panic, or unexpected medical complications while in or under the water.
You voluntarily choose to explore these training pathways and assume full responsibility for the inherent physical risks associated with preparing for, participating in, and completing scuba diving training.
3. Medical Fitness and Prerequisites
Safety is our absolute priority. Scuba diving places unique physiological demands on your body.
- You agree that you must honestly and accurately complete all standard medical questionnaires provided by Scuba Quest WI LLC and our affiliated certification agencies prior to any in water activities.
- If any medical condition or contraindication is noted on your forms, you accept full responsibility for obtaining a formal, signed medical evaluation and clearance from a licensed physician before you will be permitted to enter a pool or open water training site.
4. Formal Liability Waivers Take Precedence
This website disclaimer provides a general outline of the risks of underwater exploration. It does not replace the binding legal documents required before training begins.
Before participating in any pool sessions, confined water exercises, or open water check out dives, you will be required to review, understand, and physically or digitally sign comprehensive, industry standard legal contracts. These include the Express Assumption of Risk, Liability Release, and Indemnity Agreement mandated by our insurance providers and training agencies. In the event of any conflict, those signed physical/digital training waivers take legal precedence over this website disclaimer.
